Heard learned counsel for the petitioners and learned High Court Government Pleader for respondent No.1.
2. This petition is filed to quash the proceedings in C.C.No.155/2025 arising out of Crime No.3/2025 registered before the Bellur Police Station (Nagamangala Circle). The case is pending before the learned Principal Civil Judge and JMFC, Digitally Signed by ANANT RAMNATH HEGDE

Nagamangala, Mandya, for the offences punishable under Sections 352, 115(2), 118(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel for the petitioners would submit that a civil dispute is pending between the parties and because of that, the present complaint is filed. Learned counsel would further submit that the charge sheet is filed without any basis and therefore, the proceedings are liable to be quashed.
Learned counsel for the petitioners has referred to the
judgment of the Co-ordinate Bench of this Court in Crl.P.No.1253/2025 and contended that, in a similar case, the Court has allowed the petition and quashed the proceedings.
4. Learned High Court Government Pleader would submit that the contents of the complaint disclose punishable offences. The charge sheet materials would disclose the wound certificate reflecting the injuries sustained by the complainant, as such, the matter requires trial.
5. The Court has considered the contentions raised at the Bar and perused the report. In the complaint dated Digitally Signed by ANANT RAMNATH HEGDE

03.01.2025, there is an allegation that the petitioners entered the house of the complainant, locked the door and assaulted the complainant and the complainant's son by using a vehicle key. It is also alleged that the complainant's son was assaulted with a brick on his leg. The complainant has also alleged that Sathish/petitioner No.1 hit the complainant on her face and was about to assault the complainant with a sickle and the neighbours came to the spot and the petitioners fled from the scene.
6. It is also stated that the complainant has lost consciousness and the police were informed by dialling 112. The police came to the spot and took the complainant and her son in an ambulance. The police, after investigation, have filed the charge sheet. The charge sheet materials would disclose the wounds sustained by the complainant as well as Vasanthkumar, complainant's son.
7. The Court is of the view that the matter requires trial. The disputed questions of fact, particularly the defence of the petitioners that such incident has not taken place, cannot be adjudicated in a petition under Section 528 of the Bharatiya Digitally Signed by ANANT RAMNATH HEGDE

Nagarik Suraksha Sanhita, 2023. The judgment relied upon by the learned counsel for the petitioners in Crl.P.No.1253/2025 has nothing to do with the present case, as the allegations in the said case and the materials placed in the charge sheet in the said case are entirely different from the materials placed in the present case.
8. Hence, the petition is dismissed.
9. It is made clear that the observations made in this
order are confined only to the merits of the petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not be construed as a reflection on the merits of the defence raised by the petitioners. All contentions are kept open.
