Present C-528 application is filed with the prayer to set-aside/ quash the charge sheet dated 09.03.2025, cognizance/ summoning order dated 02.05.2025 and the entire proceedings of Criminal Case No.839 of 2025, pending in the Court of learned Additional Chief Judicial Magistrate, Kotdwar, District Pauri Garhwal on the basis of compromise between the parties. 3. A compounding application (I.A. No.1 of 2026) has also been filed in the present matter praying that the offences be permitted to be compounded in view of the compromise arrived at between the parties. 4. It is reported that the applicant is presently in jail. Mr. Aslam, duly authorized by the applicant to file the compounding application, appeared before this Court and was identified by the applicant's counsel. The authorization letter, signed by the applicant and forwarded by the Jailor of District Jail, Pauri (Garhwal), is on record. Respondent No. 2 joined the proceedings via video conferencing and was identified by his learned counsel. Both parties have filed affidavits affirming the compromise entered into between them. 5. It is jointly submitted by the parties that the dispute between them has been amicably settled and they have resolved all their differences. 6. Learned State Counsel vehemently opposed the compounding application. 7. Hon’ble Supreme Court, in a catena of its judgments, has observed that in cases where because of the compromise arrived at between the parties, possibility of conviction is remote and bleak, the High Court may quash the criminal proceedings as continuation of the same would cause great prejudice and injustice to the accused. 8. Following the aforesaid ratio, present compounding application is allowed. The offences between the parties are permitted to be compounded. As a result, entire proceedings of Criminal Case No.839 of 2025, pending in the Court of learned Additional Chief Judicial Magistrate, Kotdwar, District Pauri Garhwal, are hereby quashed, qua the applicant. Liberty is granted to the applicant, who is in jail, to approach the Magistrate concerned for obtaining the order for their release. 9. C-528 application stands disposed of.
