18.09.2026 Serial no. 274 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1780 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with NDPS Cse No. 48 of 2025 arising out of GR Case No. 1674 of 2025 [Ultadanga PS Case No. 129 dated 16.08.2025 u/s 20(b)(ii)(C)/29 of the NDPS Act. -And- In the matter of : Biswajit Bisws @ Mimo … Petitioner(s) Mr. Satadru Lahiri Mr. Safdar Azam Mr. Poulam Dey … for the Petitioner(s) Mr. Brajesh Jha Mr. Neel Chakraborty … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been implicated in connection with the present case only on the basis of statement of a co-accused and there has been no recovery from the present petitioner. The petitioner is in custody for more than 11 months. State has produced the documents of the service provider which reflects the application and documents which were submitted by the present petitioner and the period for which the activity of the mobile phone was on in respect of 9038371361. It is reflected from the summary of the communications which have been supplied is the phone 2 number which is alleged by the prosecution to be of the present petitioner having communication with the other accused person [Biswanath Dalui] being 102 in number for the check period. Learned advocate for the petitioner again argues that the said document was not supplied to the petitioner in course of the relied upon documents being handed over. State is directed to hand over the copies submitted before the learned Special court which would include application of the present petitioner, the communication of the service provider and the number of phone calls as also the documents reflecting 102 phone calls which the prosecution claims to have been communicated between the principal accused and the present petitioner. Having considered that there were communications between the present petitioner and rest of the accused upon alleged recovery of 94.325 kg of ganja from two other accused persons, I am of the opinion that until further fact is surfaced, it would not be fit and proper to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. The learned trial court would ensure that there is progress in the case as expeditiously as possible. 3 Accordingly, CRM (NDPS) 1780 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Documents supplied be kept with the record.
