ORAL ORDER
1. Accused in Crime No.108/2026 registered by Sulibele Police Station, Bengaluru, for the offences punishable under Sections 103(1), 351(2) and 352 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.108/2026 was registered by Sulibele Police Station, Bengaluru, for the offences punishable under Sections 109, 351(2) and 352 of BNS, 2023, against the petitioner herein based on the first information dated 29.07.2026 received from Gangadhar, who is the brother of deceased Muniraju. During the course of investigation of the said case, petitioner was arrested on 02.08.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.1744/2026 was rejected on 20.08.2026. Therefore, he is before this Court. 4. A reading of the first information as well as the remand application of the petitioner would reveal that on 28.07.2026

when petitioner was at a bar and restaurant, Muniraju, who had gone there, allegedly had demanded payment of arrears of wages for the work done by him. Petitioner allegedly abused and pushed Muniraju and as a result, Muniraju fell down and suffered head injury. Immediately thereafter, he was shifted to a Hospital and FIR was registered against the petitioner invoking the offence punishable under Section 109 of BNS,
2023. It appears that subsequently injured Muniraju, had died in the Hospital while undergoing treatment and therefore, the offence punishable under Section 103 of BNS, 2023, was invoked in the present case. 5. Post-mortem report of the deceased, which is made available to this Court would go to show that except one injury at the hind side of the head, the deceased had no other injuries on his body. Even according to the prosecution, petitioner only had pushed Muniraju and as a result, he fell down and suffered head injury. Considering the background in which the incident in question had taken place and the injury suffered by the deceased, the following order:-

6. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.108/2026 registered by Sulibele Police Station, Bengaluru, for the offences punishable under Sections 103(1), 351(2) and 352 of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
