The captioned writ petition is filed seeking to quash the impugned notices dated:05.06.2026, 15.06.2026 and 20.06.2026 issued by respondent No.3 - 3 - HC-KAR CNR: KAHC010434902026 NC: 2026:KHC:51793 WP No. 19527 of 2026 and a mandamus seeking appropriate direction prohibiting and restraining the respondents from closing the entrance gate access to the sales outlet shop of the petitioner. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the papers with care. 4. Suffice it to note that the third respondent has issued notices to the petitioner vide Annexures-D, E and F. Instead of submitting a reply to the said notices, the petitioner has approached this Court in haste. In the circumstances, this Court is not inclined to entertain the writ petition. The petitioner is, however, at liberty to submit his reply to the said notices, if so advised. The petitioner has also sought a writ of mandamus directing the respondents not to close or obstruct access to the entrance gate of the sales outlet shop of the petitioner. The said relief cannot be considered in the present proceedings, as its adjudication would involve - 4 - HC-KAR CNR: KAHC010434902026 NC: 2026:KHC:51793 WP No. 19527 of 2026 disputed questions of fact, which cannot appropriately be examined in exercise of the writ jurisdiction of this Court. Lastly, counsel appearing for the petitioner submits that the interim order granted earlier may be continued on the ground that there is an apprehension of dispossession. The said submission is taken note of. However, in view of the dismissal of the writ petition, the interim order cannot be continued. Further, the alleged threat of dispossession involves disputed questions of fact and cannot be adjudicated upon in the present writ proceedings. The petitioner may approach the appropriate forum, if so advised and if permissible in law. It is made clear that this Court has not expressed any opinion on the merits of the case. Accordingly, the writ petition stands dismissed. Consequent upon the dismissal of the writ petition, any interim order granted earlier shall stand - 5 - HC-KAR CNR: KAHC010434902026 NC: 2026:KHC:51793 WP No. 19527 of 2026 vacated/discharged.
