GP FOR SERVICES I The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.17170 of 2026 O R D E R: The Writ Petition is filed questioning the action of the Respondent No.2 in placing the Petitioner indefinitely temporarily out of contract through Proceedings No.63/2024/DVC/PRP/B4/16, dated 13.11.2024 as illegal and arbitrary. 2. The Petitioner is working as Mandal Technical Assistant under NREGS Programme implemented by the District Water Management Agency, Visakhapatnam. While conducting social audit for the financial year 2023-2024, the Respondent Authorities found certain irregularities against the Field Assistants, for which, the Petitioner was placed under suspension and his contract was temporarily suspended through the impugned Proceedings pending enquiry. 3. Learned counsel for the petitioner submits that in terms of Clause 13(B)(5) of the Field Assistants Human Resource Policy, the inquiry ought to be completed within thirty days. Though show- cause notice came to be issued, the inquiry has not been completed so far, contrary to the aforesaid timelines and on top of it, the respondents have now placed the petitioner under suspension, which is arbitrary and illegal. 4. Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondent Nos.3 and 4, on the other hand, submits that the inquiry is going on and the same would be concluded within three (03) weeks from now. However, does not refute the submissions on 3 timelines envisages under aforesaid policy. 5. In view of the same, the Writ Petition is disposed of, by setting aside the impugned proceedings dated 13.11.2024, issued by the Respondent No.2, and the respondents are directed to reinstate the petitioner into service forthwith. Further, the Respondent No.2 is directed to conclude the inquiry, after providing due opportunity of hearing to petitioner, within a period of three (03) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
