Vide the present writ application the petitioner herein prays for direction upon the learned ESI Court, Calcutta, to dispose of the Misc. Case No. 02 of 2026, prior to 30th September, 2026, which is a prayer for restoration of ESI Case No. 89 of 1997, dismissed for default, in order to enable the petitioner to avail the amnesty scheme floated by the ESIC. 3. The petitioner now wants to avail Amnesty Scheme, 2025 floated by the ESI Corporation which expires on 30th September, 2026, and it appears that vide an order dated 1st June, 2026, the ESI Court fixed the next date on 5th October, 2026, which prima facie will not enable the petitioner to avail of the Amnesty Scheme, 2025, which expires on 30th September, 2026. 2 4. Mr. Prasad, learned counsel appearing for the ESI Authorities submits that he has no objection to the relief prayed for by the petitioner herein. 5. Considering the said facts, the writ application is disposed of with the direction that the ESI Court shall pass necessary orders by preponing the date of Misc. Case which is a prayer for restoration to 23rd September, 2026 and dispose of the same in accordance with law keeping in mind that the petitioner intends to avail of the Amnesty Scheme, 2025. 6. The order dated 01.06.2026 of the ESI Court is accordingly modified. 7. The writ application stands disposed of. 8. Connected application, if any, stands disposed of. 9. Interim order, if any, stands vacated. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
