This application under Article 227 of the Constitution of India is at the instance of the Syama Prasad Mookerjee Port, Kolkata and is directed against an
order being no.2 dated 4th August, 2026 passed by the learned Chief Judge, City Civil Court, Calcutta in Misc. Appeal No. 40 of 2026. By the order impugned an order of stay of operation passed by the Estate Officer for a limited period subject to payment of occupational charges. After some argument Mr. Nag, learned advocate appearing for the petitioners on instructions, submits that a direction be passed upon the learned judge of the appellate court to dispose of the Miscellaneous Appeal No. 40 of 2026. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioners shall be obliged to forward a copy of this application along with server copy of
2 this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned judge of the appellate court forthwith. In the light of the submissions made by the learned advocate for the petitioner, C.O. 3149 of 2026 stands
disposed of without interfering with the order impugned and by requesting the learned Judge, 6th Bench, City Civil Court at Calcutta to make an endeavour to dispose of Miscellaneous Appeal No. 40 of 2026 as expeditiously as possible without granting any unnecessary adjournments to either of the parties keeping in mind the time frame fixed in the statute for disposal of such appeal. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
