ORAL ORDER
1. Accused no.1 in Crime No.298/2026 registered by Yelahanka New Town Police Station, Bengaluru City, for the offences punishable under Sections 109(1), 117(2), 351(2), 352 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.298/2026 was registered by Yelahanka New Town Police Station, Bengaluru City, for the aforesaid offences, against the petitioner herein and his brother, based on the first information dated 07.07.2026 received from Nishchith.S., who is the injured witness in the present case. During the course of investigation, petitioner was arrested on 07.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.7862/2026 was rejected on 14.08.2026. Therefore, petitioner is before this Court. - 3 -

4. A reading of the first information would go to show that petitioner and accused no.2 are brothers. On 06.07.2026, first informant while returning home from his office in his two- wheeler had stopped on his way to have a cup of tea near Doddabettahalli bus stop.
A car bearing registration No.KA-04- 9898 came from opposite side and dashed against his vehicle and as a result, he fell down from the vehicle. Petitioner, who got down from the said car assaulted the first informant with a weapon after abusing him and his family members. It appears that the accused persons and the first informant have some civil dispute which is pending before the court. It is in this background, the alleged incident had taken place. 5. The wound certificate of the victim would go to show that he has suffered three injuries, out of which, the third injury is dislocation of third metacarpal of left hand, which is described as a grievous injury. The said grievous injury is not caused on the vital part of the victim's body. Major portion of the investigation is completed. Accused no.2 has been released on bail before the Sessions Court. It is brought to the notice of this Court that petitioner has no criminal antecedents. Under the

circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
6. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.298/2026 registered by Yelahanka New Town Police Station, Bengaluru City, for the offences punishable under Sections 109(1), 117(2), 351(2), 352 read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
