Mr. M.C. Kandpal, Senior Advocate, assisted by Mr. Devesh Kandpal, Advocate for the petitioner. Mr. N.K. Papnai, Standing Counsel, for the State. (2) Petitioner is serving as Assistant Accountant. She is posted in the O/o Divisional Forest Officer, Almora. In this writ petition, she has challenged the order dated 6.8.2025, passed by DFO, Almora, whereby respondent no. 4 was handed over the charge of post of Accountant till further orders. (3) Learned Senior Counsel appearing for the petitioner submits that respondent no. 4 has now been transferred to O/o Conservator of Forest, Almora. He further submits that petitioner has also been granted regular promotion to the post of Accountant upon her clearing a departmental examination. Thus he submits that in view of these two developments, the impugned order cannot be sustained in the eyes of law. (4) Learned State Counsel, however, submits that since there were serious complaints received against the petitioner and DFO concerned had also issued warnings to the petitioner, therefore, in view of administrative exigencies, respondent no. 4 was handed over charge of Accountant. He, however, submits that if petitioner makes representation in view of her regular promotion as Accountant and also in view of transfer of respondent no. 4, 2026:UHC:985 competent authority shall take decision on the same, as per law. (5) Writ petition is, accordingly, disposed of with liberty to petitioner to make representation to Conservator of Forest, Almora. If she makes representation within one week from today, decision thereupon shall be taken, as per law, within three weeks thereafter.
