Accused No.1 in Crime No.195/2026 registered by Rajagopal Nagar Police Station, Bengaluru City, for the offences punishable under Sections 189(2), 191(2), 115(2), 137(2), 64, 351(2) read with Section 190 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.195/2026 was registered by Rajagopal Nagar Police Station, Bengaluru City, for the aforesaid offences against the petitioner and others, based on the first information dated 14.06.2026 received from the victim lady, aged 24 years. petitioner was arrested on 27.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.7794/2026 was rejected on 22.08.2026. Therefore, he is before this Court. 4. A reading of the first information would reveal that the victim is a married lady. In the first information, it is stated that the petitioner herein is known to her since the year 2019 and prior to her marriage, they were in love. The first information would reveal that marriage of the victim lady was performed in the year 2021 by her parents with one Gangadhar. It is alleged that subsequently, after ascertaining her address, the petitioner had come near the matrimonial house of the victim lady in which she was living with her husband and requested her to come with him. When she opposed, he allegedly threatened of revealing her photographs to her husband. 5. On 15.05.2026, the petitioner allegedly came near her house in a car and took her forcibly in the said

car to Kushtagi, where they stayed in the house of his relative. In the said house, he allegedly had forcible sexual intercourse with her. Subsequently, on 18.05.2026, he allegedly released her and after returning home, belatedly she had approached the Police on 06.06.2026. Based on her first information, FIR has been registered against the petitioner and his relatives. 6. From a reading of the first information itself it appears that the petitioner and the victim lady were in love prior to her marriage.
The allegation now made against the petitioner is that, he had forcibly taken her on 15.05.2026 to Kushtagi, stayed there in his relative’s house and had forcible sexual intercourse with her. Though she was released by him on 18.05.2026 itself, she had approached the police belatedly on 06.06.2026. The FIR, which was registered on 06.06.2026 at Kowthal Police Station, Raichur was subsequently transferred to Rajagopal Nagar Police Station, Bengaluru and numbered as Crime No.195/2026. - 5 -

Considering the relationship between the parties, the allegations found in the first information and also the inordinate delay in approaching the Police, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:
O R D E R
i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in Crime No.195/2026 registered by Rajagopal Nagar Police Station, Bengaluru, for the offences punishable under Sections 189(2), 191(2), 115(2), 137(2), 64, 351(2) read with Section 190 of BNS, 2023, subject to the following conditions:
a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
