ORAL ORDER
1. Accused No.1 in Crime No.97/2026 registered by Dibburahalli Police Station, Chikkaballapura, for the offences punishable under Sections 115(2), 126(2), 318(2), 189(2), 318(4), 190, 85, 351(2), 352, 54 and 67 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.97/2026 was registered by Dibburahalli Police Station, Chikkaballapura, for the aforesaid offences against petitioner and his relatives based on the first information dated 30.06.2026 received from the victim girl aged 19 years. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.198/2026 before the jurisdictional Sessions Court, which was rejected on 06.08.2026. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that petitioner aged 21 years and victim girl aged 19 years were in

love for the last about three years.
On 03.03.2026, petitioner had taken the victim girl to a temple at Mantralaya and in the room where they stayed, he allegedly had sexual intercourse with her against her wishes. Subsequently, he had taken the victim girl to his sister's house and the relatives of the petitioner informed the victim girl that petitioner will not cheat her. Subsequently, petitioner's phone was found switched off and therefore, victim girl had approached the jurisdictional police on 24.06.2026. Police had thereafter summoned the petitioner to the police station and in the presence of relatives and villagers, marriage of the petitioner and the victim girl was subsequently performed. She has alleged that thereafter the relatives of the petitioner abused her using filthy language. Petitioner, who had brought her back home had sexual intercourse with her for about three days and thereafter abandoned her and till date, he has not returned home. It is under these circumstances, she had approached the police on
30.06.2026. 5. A reading of the first information would reveal that petitioner and the victim girl, who were in love for a period of

about three years are now married on 24.06.2026. First information is subsequently filed on 30.06.2026, alleging that petitioner, who had gone out of the house, abandoning the victim girl had not returned home. Petitioner has undertaken to cooperate with the police for the purpose of investigation. Maximum punishment for alleged offences is imprisonment for a period of seven years. Considering the nature of allegations found in the first information and the relationship between the parties, I am of the opinion that if the prayer made by the petitioner is granted, the same would serve the ends of justice. Accordingly, the following order:-
6. The petition is allowed.
The respondent-Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.97/2026 registered by Dibburahalli Police Station, Chikkaballapura, for the offences punishable under Sections 115(2), 126(2), 318(2), 189(2), 318(4), 190, 85, 351(2), 352, 54 and 67 of BNS, 2023, subject to the following conditions:
a) Petitioner shall appear before the Investigation Officer on 03.10.2026 at 10.30 a.m. and on

the said date, the Investigation Officer is at liberty to take him into custody if necessary for the purpose of interrogation. However, it is made clear that after interrogation, Investigation Officer shall release the petitioner on the same day on or before 06.00 p.m. subject to petitioner executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Investigating Officer;
b) Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons;
c) Petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon;
