JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the prayers running into 12, as follows: “Wherefore it is prayed that this Hon’ble Court be pleased to: i. Issue Rule Nisi. ii. Issue a Writ of Mandamus and call for the Lower Court Records in Crl. Misc. No. 1310/2022, Crl. Misc. No. 216/2023, M.C. No. 217/2022, M.C. No. 74/2023 and Crl. Misc. No. 499/2026 and examine the legality, propriety and correctness of the proceedings therein. iii. Issue a Writ of Mandamus directing immediate enforcement of the interim maintenance order dated 14.11.2025 passed in Crl. Misc. No. 1310/2022, recovery of maintenance arrears and continuation of monthly maintenance payments in accordance with law, at Annexure F. iv. Issue a Writ of Mandamus directing disposal of Crl. Misc. No. 216/2023, M.C. No. 217/2022 and M.C. No. 74/2023 within four weeks from the date of receipt of this Hon’ble Court’s order. - 3 - HC-KAR CNR: KAHC010051422026 NC: 2026:KHC:50459 WP No. 2669 of 2026 v. Issue a Writ of Mandamus directing the concerned courts to take up Crl. Misc. No. 1310/2022, Crl. Misc. No. 216/2023, M.C. No. 217/2022 and M.C. No. 74/2023 on priority, avoid unnecessary adjournments, conduct day-to-day hearing wherever necessary and dispose of the proceedings, including all pending interlocutory applications, within three months. vi. Direct the Respondent to clear all maintenance arrears and continue monthly maintenance payments in accordance with the order dated 14.11.2025, at Annexure F. vii. Direct the Respondent to provide suitable alternate residential accommodation to the Petitioner or, alternatively, pay the monthly home loan EMI of ₹17,200/- and reimburse all amounts paid towards such EMI by the Petitioner and/or her aged widowed mother from September 2022 till date. viii. Direct the Respondent to file within two weeks a complete affidavit of assets and liabilities disclosing all immovable properties, bank accounts, income sources, business interests, Income Tax Returns and supporting financial records. ix. Direct the courts concerned, while determining maintenance, residence-related reliefs, litigation expenses and permanent alimony, to consider the prevailing cost of living in Bengaluru, the Petitioner’s housing requirements, medical condition, future treatment expenses, earning capacity, career interruption, exclusion from the matrimonial home, continued dependence upon her aged widowed mother for subsistence and housing, diversion of the widowed mother’s family pension towards maintenance and housing expenses, the Respondent’s assets, income sources, business interests and the standard of living enjoyed during the - 4 - HC-KAR CNR: KAHC010051422026 NC: 2026:KHC:50459 WP No. 2669 of 2026 marriage, and thereafter pass reasoned orders in accordance with law. x. Direct the concerned courts to place before this Hon’ble Court a compliance/status report regarding enforcement of maintenance, disposal of pending applications and progress of the proceedings. xi. Award costs of these proceedings. xii. Pass such other writ, order or direction as this Hon’ble Court may deem fit and proper in the interests of justice, equity and good conscience.” 2. The party in person/Wife had sought as many as 9 prayers. Except prayer number IV, the other reliefs cannot be considered by this Court. By way of prayer number IV, the party in person is seeking expeditious disposal of the Crl.Misc.No.216/2023 and M.C.No.217/2022, on the file of the Family Court, Bengaluru. There is huge pendency on the file of the Family Court, even matters of 2017 are pending for adjudication. The Apex Court, in the case of High Court Bar Association, Allahabad Vs. The State of Uttar Pradesh in Crl.A.No.3589/2023 dated 29.02.2024, had observed that the High Court cannot casually direct the trial Court to dispose of the matter unless it warrants interference. Accordingly, this Court is passing the following: ORDER i. Accordingly, the Writ Petition is dismissed. ii. All pending I.As., in the writ petition shall stand closed.
