1. The petitioner, Alok Bandhopadhyay, has contended that his father died on 31.10.2017. A death certificate was issued by one Doctor Tapas Chatterjee certifying sudden cardiac arrest. 2. The petitioner became suspicious of the background of the said Doctor and upon inquiry, it transpired that no Doctor in the name of Tapas Chatterjee held registration number 7181, which was claimed to have been given to the said Tapas Chatterjee. 3. After a complaint was lodged by the petitioner, Maheshtala P.S. Case No. 40 of 2024 dated 01.02.2024 was registered for investigation into the offences punishable under Sections 419/468/471 of the Indian Penal Code read with Section 15 of the Indian Medical Council Act, 1965, against the said Tapas Chatterjee. 4. The petitioner's grievance in the writ petition is that the police had not taken concrete steps in the matter, and accordingly, a writ in the nature of mandamus has been prayed for, directing respondent nos. 1 to 13 to take proper steps and conduct a fair investigation into the matter. 5. A report was called for from the State with regard to the status of the investigation of the said case. 6. The State, pursuant to the order of this Court, has filed a report dated 17.09.2026 stating that upon registration of the said case, the accused was interrogated and in the course of the investigation, the accused surrendered before the learned Magistrate and was enlarged on bail. It further transpires from the report filed by the State that on 18.12.2025, a charge-sheet was submitted against Tapas Chatterjee bearing C.S. No. 545 of 2024 dated
26.11.2025. 7. It has been further informed to the Court that after the registration of the said case, the said Tapas Chatterjee is no longer practicing and his chamber is lying sealed. A photograph in support of such contention is also annexed to the report. 8.
In view of the aforesaid, the learned Advocate for the State submits that the allegations made against the police are utterly unfounded as the police have taken due steps in the matter and investigated the case, which has resulted in the submission of a charge-sheet. 9. A copy of the report was handed over to the learned Advocate for the petitioner, who, after perusal of the same, submits that in view of the subsequent submission of the charge-sheet in the matter, nothing survives in this writ petition. However, he craves leave of the Court to agitate his further grievances, if any, in the course of the trial of the case before the Jurisdictional Magistrate. 10. It appears from the aforesaid that since the said

Tapas Chatterjee has already been charge-sheeted and is no longer practicing as a Doctor and particularly in view of the fact that the matter is now pending trial before the Court below, no further orders are required to be passed in the present writ petition. 11. The writ-petition being WPA/20945/2024 is accordingly disposed of on the above observations and there will be no order as to costs. (Anuj Singh, J.)
