Heard both the sides. This bail application has been filed on behalf of Muneshwar Ganjhu @ Vikram Ji who is in custody since 27.09.2024 in connection with Budmu P.S. Case No. 18 of 2024 for the offence registered under Sections 414 and 34 of the IPC and Section 17 of C.L.A. Act pending in the Court of J.M. 1st Class, Ranchi is pressed into motion. It is submitted by learned counsel for the petitioner that the offence under Section 414 of IPC will not be made out against the petitioner as neither he was arrested on spot, nor any stolen article was seized from his conscious physical possession. The name of the petitioner has come up on the confessional statement of co-accused Dileshwar Kumar Ganjhu from whom stolen motorcycle is said to have been seized. Other similarly situated co-accused has been granted bail by the Co-ordinate Bench of this Court in B.A. No. 9230 of 2025. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
