Mr. Hari Pada Nayak. … for the Union of India. 1. The petitioners are the family members of late Sajal Kumar Basu, who expired on February 28, 2021. The petitioners are aggrieved that upon the death of Sajal, who worked as a Cipher Inspector under the Eastern Railways till 1989, a sum of Rs. 5,00,785/- had been wrongfully debited from the pension account of Sajal. 2. The petitioners had run from pillar to post and were informed that the debit had been made in view of the fact that the Life Certificate of Sajal had not been furnished, nor had the Death Certificate being furnished. This amount was deducted/wrongfully debited on February 12, 2022. 3. This action of wrongfully debiting the amount has been assailed in this writ petition. 4. Mr. Samanta, learned Advocate appearing for the petitioners, submits that during pendency of the writ petition, the entry has been reversed and the amount 2 has been duly credited on September 9, 2025. 5. The authorities have realized their mistake and by the letter dated September 19, 2025 have refunded the amount. A copy of such letter as furnished is kept on record. 6. The petitioners are aggrieved that they have been deprived of the interest from February 12, 2022 till September 8, 2025, when the amount remained debited, wrongfully from their account. The petitioners are the family members of a deceased employee and cannot be made to suffer by the wrongful act on behalf of the authorities in debiting their account. 7. In view of the afore-stated, I direct the respondent no. 4 to disburse the appropriate sum after calculating interest at the rate of 6% per annum during the period February 12, 2022 till September 8, 2025. This is a reasonable rate of interest considering the Bank’s rates applicable to fixed deposits. 8. Let such amount be calculated and quantified by October 10, 2026. The same will be disbursed and credited to the account of the petitioners by October 15, 2026. 9. With the afore-stated directions, the writ petition is disposed of. 10. There, shall, however, be no order as to costs. 11. All parties shall act on the basis of a server copy of 3 this order duly downloaded from the official website of this Court.
