Item.35 16.09.2026 ssi Ct. 3 WPA 16507 of 2026 Sri Sri Mahakal Jiu Debottar Estate. -vs- The State of West Bengal & others. Mr. Arnab Dutt Mr. Tathagata Ganguly …for the petitioner Ms. Sonal Sinha Mr. Ankit Sureka …for the HMC 1. Although by an order dated 17th July, 2026, this Court had permitted the Municipality to file an additional report so as to disclose the sketch plan in respect of the deviated portions, no such report till date has been filed. The learned advocate for the petitioner, however, has placed before this Court the instruction dated 11th September 2026 and would submit that he has instruction to withdraw the writ petition. 2. Noting that the instant writ petition was filed inter alia, challenging the public notice for demolition dated 10th July 2026 issued by the Assistant Engineer (Demolition) Building Department, Howrah Municipal Corporation concerning WPA 16507 of 2026 2 demolition of the unauthorized portion of the G+7 storied building at Premises No.63, Joya Bibi Road, Ward No.01, P.S. Malipanchghora, Howrah 711107 and also considering the submissions of Mr. Dutt, learned advocate for the petitioner that the Municipality has already demolished a majority of the illegally constructed portion i.e., the additional three (5th, 6th and 7th) floors, I am of the view, no fruitful purpose would be served in retaining the writ petition on the file. 3. The Municipality, however, must ensure due execution, of the demolition order and file a report enclosing colour photographs of the demolished portions, before the learned Registrar General of this Court within a period of 12 weeks from this date. 4. With these observations and directions, the writ petition is disposed of. (Raja Basu Chowdhury, J.)
