GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: SRK, J W.P.No.10255 of 2026 3 O R D E R This Writ Petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, questioning the action of the respondents in not paying pending admitted bills for an amount of Rs.8,79,254/- + Rs.6,72,173/-, in total Rs.15,51,427/- for the works (i) construction of CC Road from Tahsildar officer to Boys Hostel in K.Kota (V) & (M), and (ii) Construction of CC Road from Boys Hostel to Culvert in K.Kota (V) & (M) in favour of the petitioner even though entire work was completed within stipulated time, is illegal and arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India, and consequently direct the respondents to clear the pending admitted bills for an amount of Rs.8,79,254/- + Rs.6,72,173/-in total Rs.15,51,427/- pertaining to the above works, and pass such other order or orders …” 2. Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development representing respondent Nos.1 and 2, learned Standing Counsel for Gram Panchayat, representing respondent No.3 and learned Assistant Government for Finance and Planning, representing respondent No.4. 3. The Writ Petitioner claims to be a Civil Contractor, used to execute all civil works in the District Level. The respondent No.2 called for different Tender works i.e. (i) construction of CC Road from Tahsildar Officer to Boys Hostel in K.Kota (V) & (M) and (ii) construction of CC Road from Boys Hostel to Culvert in K.Kota (V) & SRK, J W.P.No.10255 of 2026 4 (M). The Tender was confirmed in favour of Writ Petitioner, and thereafter, an Agreement was executed between Writ Petitioner and 2nd respondent. The Writ Petitioner completed the entire work and submitted M-Book, and after thorough verification, 2nd respondent approved the M-Book and submitted the same to the Officers concerned, for finalization of Bills for an amount of Rs.15,51,427/-. Though one year time has elapsed, and repeated requests have been made by the Writ Petitioner, the respondents are not paying the pending bills to the Writ Petitioner. According to Writ Petitioner, having executed the work satisfactorily, within the prescribed time, non- payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount. 4. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the Executive Engineer/FAC, PR Division, Jangareddigudem-2nd respondent, submits that the Writ Petitioner is entitled to a net amount of Rs.15,51,427/- after statutory deductions such as Seigniorage charges, QC Charges etc., aggregating to Rs.1,38,828/-. Learned Assistant Government Pleader further submits that the Material Sheet (M33469) was generated for the works done by the Writ Petitioner, in SRK, J W.P.No.10255 of 2026 5 MCC Programming Officer (MPDO) Login on 13.05.2026, and the amount has to be released by the Commissioner RD. The written instructions are placed on record. 5. Having regard to the fact that, there is no dispute with regard to the works executed by the Writ Petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.15,51,427/- (Rupees Fifteen Lakhs Fifty One Thousand Four Hundred and Twenty Seven only) to the Writ Petitioner within a period of Two (2) months from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition.
