Ms. Debjani Sahu Mr. Subrata Ghosh ……for the Petitioners. Mr. Sreshtha Ghosh Ms. Sanjana Jha ….for the State. Report submitted by the State enclosing the photograph of the present petitioner which was taken after the direction was passed on 11.09.2026 be kept with the record. I have taken into account the submissions advanced by Ms. Sahu, learned advocate for the petitioner that the petitioner is handicapped. One of his hands are amputed. Having considered the report submitted by the police authorities, I am of the opinion custodial detention of the present petitioners is not warranted. 2 Accordingly, prayer for anticipatory bail of the petitioners is allowed. As such, I direct that in the event of arrest, the petitioners, namely, (1) Sukumar Biswas, (2) Suchitra Biswas, (3) Sanchita Biswas be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since the investigation is being carried out, petitioner shall report to the investigating officer within a period of 10 days and on all subsequent dates as and when required for the purposes of investigation till the report in final form is submitted before the jurisdictional Court. Accordingly, CRM (A) 2563 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
