Heard the parties.

Admittedly, the petitioner is a convict. Though the offence is under Section 138 of the Negotiable Instrument Act, 1881, the sentence of the petitioner is simple imprisonment for one year. Admittedly the criminal appeal filed by the petitioner also stood dismissed and a revision is pending before this Court.

The petitioner has been dismissed from the service on the ground that he has been convicted in a criminal case. The facts that the petitioner is a convict in the criminal case has not been denied by the petitioner and the said conviction has also been upheld in the appeal has also not been denied. Only ground which the petitioner is taking is that the Revision Application is pending and he is on bail and the offence does not come within the meaning of moral turpitude.

Be that as it may, the fact that the petitioner cannot

deny that he is a convict and he has to undergo imprisonment for one year which has been suspended by the order of this Court.

Since the Revision Application is still pending, I am not inclined to entertain this writ petition to grant relief to the petitioner.

The petitioner, if so advised, may approach the appropriate authority after disposal of the Criminal Revision Application No.409 of 2021 which is pending before this Court.

This writ petition stands dismissed.
