Nanda, learned counsel for the petitioner and learned A.P.P. for the State. The petitioner is an accused in connection with Kamdara P.S. Case No. 67/2025. The petitioner is alleged to have committed rape upon the informant and had also taken away Rs. 60,000/- in cash and Rs. 2,00,000/- worth of jewelry. It has been submitted by the learned counsel for the petitioner that the informant appears to be a consenting party to the sexual overtures made by the petitioner. Learned counsel submits that the petitioner is in custody since 29.12.2025. Learned A.P.P. has opposed the prayer for bail of the petitioner. It appears from the allegations that the informant had gone to her ancestral home and the petitioner is said to have entered after breaking open the latch but even then, the informant did not raise any hue and cry and let the petitioner touch her later realizing that it was not her husband but the petitioner. It also seems that the informant knew the petitioner from before. The reading between the lines as given in the First Information Report gives out an altogether different story indicating consent on the part of the informant. Regard being had to the above, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Gumla in connection with Kamdara P.S.
