Das Mr. Priyankar Ganguly … for the Union of India Learned advocate for the petitioner submits that the petitioner was arrested on 23.04.2024 and since then he is in custody. Although, charge-sheet has been submitted but till date only three witnesses have been examined out of the 11 witnesses cited by the prosecution. There is no possibility of the trial being concluded in near future, as such, learned advocate prays that the petitioner may be released on bail, as the initial claim of the prosecution relates to the contraband being challenged after the forensic report reached the court. State opposes the prayer for bail and submits that there is another case against the present petitioner. The quantum of seizure is of commercial quantity. 2 I have taken into account the modus operandi of the present case and the antecedent of the present petitioner. Having regard to the same, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. The learned trial court would pre-pone the examination of the independent witnesses. The petitioner would renew his prayer for bail after the evidence of the independent witnesses is over. Accordingly, CRM (NDPS) 1901 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
