ORAL ORDER
1. Accused in Crime No.127/2026 registered by Kyathanahalli Police Station, Mandya District, for the offences punishable under Sections 132, 115(2), 352, 351(2) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.127/2026 was registered by Kyathanahalli Police Station, Mandya District, for the aforesaid offences against the petitioner herein based on the first information dated 12.08.2026 received from Savitha B. Police Patil, PSI of Women Police Station, Mandya. Apprehending arrest in the case, petitioner had approached the jurisdictional

Sessions Court in Crl. Misc. No.5303/2026 which was rejected on 31.08.2026. Therefore, she is before this Court. 4.
Learned Senior Counsel appearing for the petitioner submits that the incident in question had taken place in a spur of moment and the assault by the petitioner was not intentional. Petitioner and her father have publicly tendered unconditional apology for the mistake that had taken place on the date of alleged incident. The maximum punishment for the alleged offences is imprisonment for a period of two years. Petitioner is a married lady having no criminal antecedents. She is ready and willing to cooperate with the police for the purpose of investigation. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP submits that investigation of the case is under progress. Accordingly, he prays to dismiss the petition. 6. First information in the present case was submitted by PSI of Women Police Station, Mandya, alleging that on 12.08.2026 when she was on bandobasth duty at Marramma

Temple at Arathi Ukkada, within the jurisdiction of Kyathanahalli Police Station, at about 4.30 p.m., petitioner along with two others came to the temple for having darshan of the deity. One of them attempted to enter Garbagudi and when the first informant tried to restrain him, the petitioner allegedly abused and thereafter slapped her on her cheek. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. 7. The material on record would go to show that the petitioner is the daughter of MLA and her husband is a serving Deputy Superintendent of Police. Petitioner is said to be a married lady having minor children. Learned Senior Counsel has produced material before this Court which would prima facie go to show that petitioner as well as her father have tendered unconditional apology publicly for the untoward incident that had taken place on 12.08.2026.
The maximum punishment for the alleged offences is imprisonment for a period of two years. Petitioner who has no other criminal antecedents, has undertaken to cooperate with the police for the purpose of investigation. Considering the aforesaid aspects

of the matter, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order:
8. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.127/2026 registered by Kyathanahalli Police Station, Mandya District, for the offences punishable under Sections 132, 115(2), 352, 351(2) of BNS, 2023, subject to the following conditions:
1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and she shall co-operate with the police for investigation and appear before them whenever called upon. - 6 -
