The writ petition has been filed by the petitioner challenging the order dated 28.07.2024 passed by MDDA, whereby the permission to construct the house and sanctioning of the map submitted before the authority has been rejected. 2. From a bare perusal of the order along with the provisions contained under Section 15 of the Uttarakhand Urban and Country Planning and Development Act, 1973, it is clear that the order was passed by the authority under Section 15(4) of the Act, 1973. Section 15(5) of the Act, 1973 provides for an appeal where an order under Section 15(4) is passed, whereby permission is refused. 3. The writ petition is, therefore, dismissed on the ground of statutory remedy of appeal available to the petitioner. The petitioner may avail the remedy as 2026:UHC:1870 2 prescribed under the provisions of Section 15(5) of the Act, 1973. 4. Pending application, if any, stands disposed of.
