JUSTICE JAYANT BANERJI) Heard the learned counsel for the complainants and the learned AGA appearing for the proforma respondent and accused Nos.2 to 4. 2. The wilful disobedience of the order dated 31.08.2023 passed in Writ Petition No.50772/2014 is alleged. By the order of the writ Court, the following directions were made: " 22. Accordingly, the order of respondent No.4 - Tahsildar at Annexure-'G' dated 12.11.2010 passed in LND/CR/15/2008-09, the order of respondent No.3- Assistant Commissioner at Annexure-'H' dated 27.12.2013 passed in R.A.No.266/2012-13 and the order of respondent No.2-Deputy Commissioner at Annexure-'J' dated 02.07.2014 passed in R.A.No.60/2013-2014 are set aside. 23. In view of setting aside of the orders of Tahsildar, Assistant Commissioner and Deputy Commissioner, the respondent Authorities to take steps to restore the names of petitioners which were deleted consequent to the impugned orders. - 4 - HC-KAR CNR: KAHC010228722025 NC: 2026:KHC:52922-DB CCC No. 393 of 2025 24. Looking into the fragile nature of original records, the respondent Authorities are directed to ensure that the original records are maintained/preserved till they are digitalized eventually as contemplated by the State Authorities and for that purpose, immediate steps are to be taken to laminate/take appropriate measures to preserve the documents till digitalization is done. Accordingly, the petition is disposed off." 3. In the compliance affidavit filed by the learned AGA, the Tahsildar Geetha V., has stated as follows: "3. I humbly submit that, being aggrieved by the order dated 31.08.2023, the Respondent State of Karnataka filed a Writ Appeal before the Division bench of this Hon'ble court in W.A.No.258/2023. The Division bench of this Hon'ble court, was pleased to dismiss the Writ appeal filed by us on 15.04.2026. Copy of the Writ Appeal is herewith produced and marked as ANNEXURE-R1. 4. I state that as per the direction of this Hon'ble Court in Writ Petition No.50772/2014 (KLR- RR/SUR) dated 31.08.2023, the name of the Original Petitioner Syed Masthan S/o Syed Mohaboob is restored in the Revenue Records vide Mutation No.MRT24/2025-26 Dated on 09/06/2026. Copy of the - 5 - HC-KAR CNR: KAHC010228722025 NC: 2026:KHC:52922-DB CCC No. 393 of 2025 same is herewith produced and marked along with English Translation as ANNEXURE-R2. 5. I state that the updated Record of Rights (RTC) dated 12/06/2026 reflecting the name of the Petitioner Syed Masthan s/o Syed Mohaboob has been generated. Copy of the RTC dated 09/06/2026 is herewith produced and marked as ANNEXURE-R3 for the kind perusal of this Hon'ble Court." 4. An unconditional apology has also been tendered. A copy of the compliance affidavit has already been served on the learned counsel for the complainants by e-mail on 22.09.2026.
