Accused no.2 in Crime No.78 of 2026 registered by Kempegowda Nagar Police Station, Bengaluru City for offence punishable under Sections 109, 351(2), 352 R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.78 of 2026 was registered by Kempegowda Nagar Police Station, Bengaluru City for the aforesaid offences against Deepanraj and the petitioner herein, on the basis of the first information dated 26.06.2026 received from Sri Jeeva, who is the injured witness in the present case. Apprehending arrest in the case, the petitioner had filed Criminal Misc.No.6609 of 2026 before the jurisdictional Sessions Court which was rejected on 10.07.2026. Learned counsel for the petitioner submits that accused no.1 has been granted anticipatory bail in Crl.P.No.11104/2026. The petitioner is ready and willing to cooperate with the police for the purpose of investigation. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP has opposed the petition. 6. Material on record would go to show that, accused and the victim are neighbours. The incident in question had taken place after the parties had fought against each other on the issue of parking of a motorbike. The allegation of assaulting the injured victim with a dragger is found as against the petitioner herein. 7. Learned HCGP has brought to the notice of this Court that the victim has suffered grievous injury as a result of assault made by the petitioner. The petitioner is a person with criminal antecedents. 8. Accused no.1 was granted anticipatory bail considering the fact that no grievous injury was suffered by the - 4 - HC-KAR CNR: KAHC010640852026 NC: 2026:KHC:52183 CRL.P No. 14308 of 2026 victim as a result of assault made by accused no.1. Considering the nature of allegations found as against the petitioner and corresponding injures caused as a result of the assault by the petitioner, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail cannot be entertained more so, having regard to the fact that he is a person with criminal antecedents. 9.
