ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a Writ of Mandamus declaring action of the respondents herein in not awarding the weightage marks for contractual service as staff nurses to petitioners herein in the final merit list dated 24.08.2020 prepared by the 3rd respondent as illegal and arbitrary and consequently declare that the petitioners also entitled for weightage marks for contractual service in the cadre of staff nurse rendered at ESI Diagnostic Centre at Sullurpet of SPSR Nellore District on par with other contractual staff nurses and consequently consider the petitioners cases for appointment as staff nurse and Lab technician on contract basis under SC category.”
2. Heard the learned counsel for the petitioners and the learned counsel for the respondents.
3. Aggrieved by the action of the respondents in not awarding weightage marks thereby failing to select the petitioners vide notification No.3 of 2020, dated 22.06.2020, the present Writ Petition is filed.

Learned counsel for the petitioners submits that following the notification both the petitioners herein have applied for the posts of Staff Nurse claiming reservations under SC(W) and also enclosed all the certificates including experience certificates issued by the competent authority. Later as per the

conditions of the notification dated 22.06.2020, the 1st respondent has prepared a provisional merit list of Staff Nurses by proceedings dated 07.08.2020 and called objections by 13.08.2020. As per the said merit list the respondents rightly given 15 weightage marks to both the petitioners herein for their contract service at ESI Diagnostic Centre, Sullurpet, which is under the control of the Director of Medical and Insurance Service, A.P. and the salaries also being paid by the State Government of A.P. Accordingly at the time of provisional merit list the respondents given weightage marks to all the Staff Nurses working in ESI dispensaries, accordingly 1st petitioner name was rightly placed at Sl.No.75 and awarded total 75.13 marks [50.13+10+15] and in respect of the 2nd petitioner though service certificate issued for both the petitioners by same Medical Officer on 07.07.2020 but the respondents without awarding weightage marks to the 2nd petitioner placed her name at Sl.No.579 total marks 61.81 [51.81+10] only and immediately within time she raised objection on 08.08.2020 with another service certificate dated 06.08.2020 and submitted to give weightage on par with other ESI Staff Nurses.
5. He further submits that later the 1st respondent has prepared a final merit list on 24.08.2020 and displayed in the website. Now, surprisingly in the final list the 1st respondent deleted the earlier awarded weightage marks to the all ESI staff nurses working on contract basis, now both petitioners names placed at Sl.No.569 and 798 with 61.81 marks and 59.56 marks. In the

remarks column it is mentioned that as per the guidelines ESI service was not considered.

Learned counsel for respondents submits that the respondent authorities filled all the posts, which are notified under notification No.3 of 2020, dated 22.06.2020 and the Writ Petition rendered infructuous.

Whereby, learned counsel for petitioners submits that un-filled vacancies still exist as per the notification dated 22.06.2020 and urges this Court to direct the respondents to consider the case of petitioners and to appoint them as Staff Nurses or Lab Technicians Grade.II on contract basis in the unfilled vacancies.

Considering the facts and circumstances of the case, without going into the merits of the case, this Court is inclined to dispose of the present Writ Petition directing the petitioners to file applications before the concerned authority within a period of one week from the date of receipt of copy of this
order asserting that to appoint them as Staff Nurses or Lab Technicians Grage-II on contract basis in the un-filled vacancies, if any. On filing of such applications, the respondent authorities are directed to consider the same within a period of six weeks from the date of receipt of applications and communicate the decision to the petitioners. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
