1. Affidavit-of-service filed today be kept on record.
2. In the writ petition, the writ petitioner alleges violation of the order dated December 24, 2024 passed by the learned Civil Judge (Senior Division), Seventh Court at Alipore in Title Suit No.1650 of 2024 by the private respondents. It further appears that although the property in question falls within the jurisdiction of Maheshtala Municipality, the Kolkata Municipal Corporation has been made a party.
3. The writ petitioner is directed to strike off the name of the Kolkata Municipal Corporation, the respondent no.1 herein, from the cause title of the writ petition in course of the day.
4. Learned counsel for the writ petitioner submits that another writ petition with regard to inaction by the Police authorities in respect of the self-same cause of
2 action is pending before the appropriate Bench of this Court.
5. Be that as it may, since the subject matter of the writ petition covers the subject matter pending in the suit as aforesaid, the present writ petition is not maintainable in this Court and, as such, the same is dismissed.
6. Accordingly, WPA 27494 of 2025 is disposed of.
7. There will be no order as to costs.
8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
