This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in FIR/Crime No.69/2026 registered at Police Station Balconagar, Police Chowki Rajgamar District Kobra (CG) for the ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.04.06 10:38:17 +0530
2 offences under Sections 75(2), 3(5) of BNS, 2023 and Sections 11, 12 of POCSO Act, 2012.

As per the prosecution case, on 01.02.2026 the applicant knocked the door of victim’s house and when the victim and her mother came out and asked why they were knocking the door, applicant Rahul Patel and another accused Gaurav started teasing the victim and further tried to outrage the modesty of the minor girl. When the victim and her mother resisted the said act of the accused persons, they started abusing her in filthy language. On which, the victim’s mother called Dial 112 and then they fled from scene.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and there is no material on record to indicate that the present applicant had any motive, animosity or to commit the alleged act. He submits that the applicant is in jail since 09.02.2026 ; charge sheet has not yet been filed and there is no immediate possibility of disposal of case, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the victim was minor and the applicant and another accused had tried to outrage the modesty of the girl at her house. He submits that the charge sheet has not yet been filed.
5. The victim along with her mother has appeared through VC from the concerned DLSA and expressed objection to grant bail.

Having considered the submissions made by learned counsel for the parties and the overall facts situation of the case as also the fact that the charge sheet is yet to be filed, I am not inclined to release the applicant on regular bail, at this stage. Accordingly, this bail application is rejected. Sd/-
