Accused in S.C.No.41 of 2026 pending before the Court of II Addl. District & Sessions Judge, Udupi arising out of Crime No.154 of 2013 registered by Karkala Police Station, Udupi District for the offences punishable under Sections 504, 506, 326 & 307 of IPC is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.154 of 2013 was registered by Karkala Police Station, Udupi District against the petitioner herein, based on the first information dated 11.12.2013 received from Sri M Ananda Gowda, brother of the petitioner. In the said case, the petitioner was arrested on 10.07.2026 and remanded to judicial custody. His bail application filed before - 3 - HC-KAR CNR: KAHC010581922026 NC: 2026:KHC:51757 CRL.P No. 13007 of 2026 the jurisdictional Sessions Court in Crl.Misc.No.298/2026 was rejected on 27.07.2026. Therefore, he is before this Court. 4. The material on record would go to show that, the petitioner and his brother Anandgowda, who is the injured in the present case had fought against each other in the background of the civil dispute. Petitioner allegedly after abusing his brother had assaulted him with a wooden club and thereafter escaped. The injured victim had suffered two injuries as a result of the assault made by the petitioner and out of the same, one injury sustained is said to be a grievous injury. 5. It appears that after the incident in question had taken place on 11.12.2013, the petitioner had abandoned his house and the documents made available to the Court would go to show that, he was working at Delhi. Subsequently, he has returned to his native place and was arrested on 10.07.2026 and remanded to judicial custody. 6. Learned counsel for the petitioner had brought to the notice of this Court that the injured victim Anand Gowda has died on 04.05.2018. The trial in the case has subsequently - 4 - HC-KAR CNR: KAHC010581922026 NC: 2026:KHC:51757 CRL.P No. 13007 of 2026 commenced and material charge sheet witnesses including alleged eye witnesses have not supported the case of the prosecution. Undisputedly, the petitioner has no other criminal antecedents. Accordingly, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.41 of 2026 pending before the Court of II Addl. District & Sessions Judge, Udupi arising out of Crime No.154 of 2013 registered by Karkala Police Station, Udupi District for the offences punishable under Sections 504, 506, 326 & 307 of IPC, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010581922026 NC: 2026:KHC:51757 CRL.P No. 13007 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
