The husband of the petitioner died in harness on September 13, 2025. She prays for grant of terminal dues. 3. In response to the prayer of the petitioner, the Headmaster of the School requested the District Inspector of Schools (SE), Tamluk to make necessary entry in the IOSMS portal for grant of family pension in favour of the petitioner w.e.f. September 14, 2025. There is no response from the end of the DI of Schools. 4. The petitioner claims to be in penurious condition and seeks immediate relief. 5. Prayer has been made to direct the authority to release the provident fund and gratuity amount of her deceased husband. 6. Prayer has also been made to consider the request of the petitioner for grant of compassionate appointment to her. 2 7. None appears on behalf of the State respondents. 8. As it appears that the husband of the petitioner died in harness and the petitioner claims to be his widow, accordingly, the DI of Schools ought to take necessary steps to ensure that the terminal dues of the deceased husband of the petitioner are released in favour of the petitioner without any further delay. 9. The DI is directed to take steps to ensure that the terminal dues of the petitioner are released at the earliest but positively within a period of four months from the date of communication of this order. 10. The school is directed to render all necessary cooperation with the DI of Schools for the purpose of making the family pension file of the petitioner ready. 11. The provident fund and gratuity shall be disbursed positively within a period of eight weeks from the date of communication of this order. 12. It is made clear that the petitioner would be obliged to comply with all the statutory formalities for disbursal of the dues in her favour. 13. As regards the prayer of the petitioner for consideration of her prayer for compassionate appointment, it appears that a separate application disclosing all details ought to be made before the DI of Schools. No such application has been made by the petitioner before the DI praying for consideration of her 3 case for grant of compassionate appointment under the died in harness category. 14. It will be open for the petitioner to apply for compassionate appointment in accordance with law, if so advised. 15. The writ petition stands disposed of. 16. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 17. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
