For Petitioners: Mr.P.Saravana Sowmiyan For Respondents: Mr.L.Jaivenkatesh, Standing Counsel ORDER This is a petition filed by the petitioner seeking a direction to the second respondent to consider her application dated 03.4.2026 for providing low tension domestic electricity service connection to her house property bearing door No.82, situated at Renugaambal Nagar, Korukkanthangal Village, Kundrathur Taluk, Kanchipuram District after obtaining necessary indemnity bond and undertaking. https://www.mhc.tn.gov.in/judis W.P.No.15994 of 2026 __________ Page3 of 8 2. Heard the learned counsel for the petitioner and the learned Standing Counsel accepting notice for the respondents. 3. The case of the petitioner is as follows: (i) The petitioner is residing in the said address along with her family for the past more than 15 years. She constructed a house there with asbestos sheet measuring 2 ½ cents. The house constructed by her forms part of a large extent of land in S.No.25, Korukkanthangal Village, Kundrathur Taluk, Kanchipuram District. The said land is classified as a natham poramboke and has been identified for granting free patta to 190 persons belonging to laundry workers’ community. Earlier, a resolution was passed on 20.3.2015 by the then Kundrathur Town Panchayat to that effect. Pursuant to that, possession of the land was handed over to the members belonging to laundry workers community even in 2015. (ii) The petitioner is also one among the beneficiaries. From 2015, the petitioner is in continuous and exclusive possession of the subject property. The petitioner’s house is assessed to property tax by Adhanur Village Panchayat from 2016. After constructing the house property, the https://www.mhc.tn.gov.in/judis W.P.No.15994 of 2026 __________ Page4 of 8 petitioner has been approaching the respondents to provide an electricity service connection. But, the respondents refused to accept the application of the petitioner on the ground that the petitioner should produce title documents/patta. The petitioner is also making repeated representations to the Revenue Authorities also for the issuance of patta. But, her request is still under consideration. (iii) On 03.4.2026, the petitioner made an online application to the second respondent for providing electricity service connection to her house property under the domestic residential category of supply. When the petitioner approached the respondents in person seeking advancement due to the ensuing summer season, they orally informed the petitioner that the proof of ownership should be produced by her. Providing the electricity service connection is a basic amenity. There are no fetters for the respondents to provide electricity service connection to the petitioner’s house property. As per Regulation 27(12) of the Tamil Nadu Electricity Distribution Code, even if the land is classified as poramboke, the electricity service connection can be given by obtaining an undertaking. This Court has carefully considered the submissions of the learned counsel on either side and perused the materials available on record. 5. When the matter is taken up for hearing, the learned Standing Counsel appearing for the respondents has produced a written communication dated 21.4.2026 from the second respondent informing that after conducting a field inspection in the subject property, it came to light that the land in question is Odai Poramboke and that the electricity service connection can be given to the petitioner’s house property only after the petitioner secures a No Objection Certificate from the Government. 6. It is also seen from the typed set of papers that the Tamil Nadu Laundry Workers’ Assembly having 190 members has already given two representations dated 18.10.2023 and 07.11.2023 to the Revenue Divisional Officer, Sriperumbudur for the issuance of house site patta. https://www.mhc.tn.gov.in/judis W.P.No.15994 of 2026 __________ Page6 of 8 Further, vide proceedings of the Revenue Divisional Officer, Sriperumbudur dated 12.12.2023, the said representation dated 07.11.2023 was, in turn, forwarded to the Tahsildar, Kundrathur to conduct an enquiry and submit a detailed report. Pursuant to that, vide proceedings dated 16.4.2025, the Tahsildar, Kundrathur, in turn, directed the Firka Revenue Inspector/Surveyor to conduct an enquiry and submit a detailed report. Hence, it is clear that the matter is still under consideration of the Revenue Department. 7. In the light of the above, this Court is of the considered view that though the Tahsildar, Kundrathur is not a party to this writ petition, it would suffice to direct the Tahsildar, Kundrathur to expedite the enquiry and take a decision within a time frame. 8. Accordingly, the writ petition is disposed of with a direction to the Tahsildar, Kundrathur to expedite the enquiry on the said representation of the Tamil Nadu Laundry Workers’ Assembly dated 07.11.2023 for the issuance of house site patta to its members and take a https://www.mhc.tn.gov.in/judis W.P.No.15994 of 2026 __________ Page7 of 8 decision on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. It is made clear that based on the outcome of the said representation dated 07.11.2023, the application of the petitioner for the grant of electricity service connection to her house property will be considered by the respondents.
