Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 9 months and similarly placed accused persons have been granted bail, as such, the petitioner may be released on bail as no evidence has surfaced against the present petitioner.
Learned advocate for the State submits that earlier the Hon’ble Supreme Court has rejected the prayer for bail of the petitioner in July, 2024. The present petitioner’s bail was also rejected by this Hon’ble High Court.
I have taken into account the materials particularly appearing in the case diary. I find that the overt acts which are surfacing so far as present petitioner is concerned is separate from rest of the accused who have been granted bail.
Petitioner is in custody for 3 years 9 months. As a matter
2 of last chance, I grant six months’ time to complete up to CSW 15 all the witnesses. Petitioner would renew his prayer for bail after the period of six months from the next date is over.
At this stage, the prayer for bail in CRM(M)329 of 2026 is dismissed.
Learned advocate for the State is directed to communicate this order to the learned trial court so that effective steps are taken in consonance with the directions passed above.
