JUSTICE JAYANT BANERJI) Learned counsel for accused No.2 has filed an affidavit tendering apology. The affidavit is taken on record. 2. This contempt petition is filed alleging wilful disobedience of the order passed by this Court in Writ Petition No.30748/2024 c/w Writ Petition No.30740/2024 dated 29.11.2024. By an order, a learned Single Judge of this Court disposed of the aforesaid two writ petitions with the following observation: "3. Accordingly, the petitions are disposed of, directing the respondents to consider the representation dated 27.09.2024 submitted by the petitioners in W.P.No.30748/2024 (Annexure-E) and the representation dated 12.09.2024 submitted by the petitioners in W.P.No.30740/2024 (Annexure-H), and pass an appropriate order in accordance with law within a period of eight weeks from the date of receipt of this order, if not already considered." 3. In the affidavit filed on behalf of accused No.2 on 05.03.2026, in paragraph No.4, has stated as follows: "4. I state that our office, by letter bearing No.NHAI/PIU-BNG/LA/2025-26/1541 dated 15th September 2025 communicated to the Petitioners in W.P. 16178/2024 which petition was filed seeking - 8 - HC-KAR CNR: KAHC010694772025 NC: 2026:KHC:51642-DB CCC No. 1373 of 2025 identical relief as in W.P.No.30748/2024 and W.P. No.30740/2024 and order passed on same line as in said two Writ petitions, stating therein that sufficient facilities have been provided in the project stretch as much as service road has been provided for various lengths of the Project stretch depending upon the site conditions and that five numbers of underpass structure also has been provided for the village roads. Subsequently, upon realizing that though Sri Ramanji Gowda (Complainant No.10 herein), one of the petitioners was common in W.P. 16178/2024 which petition was filed seeking identical relief as in W.P. No.30740/2024 said communication was not sent to all the petitioners of the said two petitions, our office issued a letter bearing No.NHAI/PIU- BNG/LA/2025-26/2696 dated 13th January 2026 (hereinafter referred to as "Endorsement") to each of the Complainants in the present case in compliance of the order dated 29th November 2024 of the Hon'ble Single Judge. It was informed to the Complainants that sufficient facilities have already been provided in view of the provision of underpass structures in the stretches from Dommalur Village to Chandrapura Cross and providing of service roads for various lengths of the Project stretch depending upon the site conditions. Copy of the letter dated 15th September 2025 was also enclosed along with the endorsement. A copy of the Endorsement along with the enclosed letter dated 15th September 2025 are produced as Annexure R1." 4. We have perused the endorsement passed. The endorsement also mentions another Writ Petition No.16178/2024 and an order of this Court passed therein on 05.07.2024. It is evident that the aforesaid order of the writ Court has been complied with. Tracking report of the endorsements sent to the accused are also enclosed evincing - 9 - HC-KAR CNR: KAHC010694772025 NC: 2026:KHC:51642-DB CCC No. 1373 of 2025 communication of the endorsement, which was delivered in January / February, 2026. 5. In the additional affidavit, accused No.2 has tendered an unconditional apology, which is accepted. In view of the aforesaid, this contempt petition is consigned.
