Court No. 6 (265719) 16.09.2026
(AD 7)
(S. Banerjee) CO 3104 of 2026
Putul Samaddar Chowdhury & Anr. Vs. Soma Lahiri
Mr. Avidip Kundu
…for the petitioners
This application under Article 227 of the Constitution of India is at the instance of the applicants and is directed against order no. 13 dated February 3, 2023 passed by the learned Civil Judge (Sr. Division), 1st Court at Barasat in Probate Case No. 68 of 2020. By the order impugned a date was fixed for evidence of attesting witness and the attesting witness was examined as PW-2 and thereafter he was discharged. July 4, 2023 was fixed for evidence of Registrar of Assurance, Calcutta. Learned advocate appearing for the petitioners submits that the petitioners are aggrieved by the portion of the order fixing a date for evidence of Registrar of Assurance, Calcutta. He submits that the evidence of Registrar of Assurance, Calcutta is yet to commence. However, no explanation has been given in the application under Article 227 of the Constitution of
2 India for the inordinate delay in approaching this Court challenging the aforesaid order. For such reason, this Court is not inclined to entertain this civil revision application. Accordingly, this revisional application stands dismissed as not entertained.
