Accused No.8 in SC No.5065/2025 pending before the Court of IV Additional District and Sessions Judge, Shivamogga, sitting at Bhadravathi, arising out of Crime No.12/2025 registered by Paper Town Police Station, Shivamogga, for the offences punishable under Sections 132, 121(1), 109(1), 61 and 58(b) of BNS, 2023 and Sections 3 and 25(1B) of the Arms Act, 1959, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Petitioner, who was arrested in the present case at crime stage on 27.02.2025 was granted regular bail by this Court in Crl.P.No.9948/2025 vide order dated 20.08.2025. It appears that subsequently, petitioner had not appeared before the Trial Court on the regular dates of hearing and therefore, coercive steps were taken against him and his presence was secured before the Trial Court on 13.07.2026 and remanded to judicial custody. His bail application filed thereafter before the Trial Court in SC No.5065/2025 was rejected on 11.08.2026. The submission made by learned counsel for the petitioner that petitioner has no other criminal antecedents is not disputed by learned HCGP. 5. On the merits of the case, petitioner was granted regular bail by this Court in Crl.P.No.9948/2025 disposed off on 20.08.2025. Only for the reason that petitioner had not appeared before the Trial Court on the regular dates of hearing, he has now been arrested and remanded to judicial custody on 13.07.2026. For the mistake committed by the petitioner, he has been sufficiently punished. Under the circumstances, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.5065/2025 pending before the Court of IV Additional District and Sessions Judge, Shivamogga, sitting at Bhadravathi, arising out of Crime No.12/2025 registered by Paper Town Police Station, Shivamogga, for the offences punishable under Sections 132, 121(1), 109(1), 61 and 58(b) of BNS, 2023 and Sections 3 and 25(1B) of the Arms Act, 1959, subject to the following conditions: - 4 - HC-KAR CNR: KAHC010589412026 NC: 2026:KHC:52028 CRL.P No. 13175 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
