The petitioner is aggrieved that persons in a separate cadre are getting promotional benefits and other consequential benefits thereof, while the petitioner in a separate cadre has not been granted such benefits. 3. The petitioner has himself opted to remain in this particular cadre, in spite of being given an opportunity to shift cadres. At this belated stage, the petitioner seeks parity with officers in a separate cadre. 4. However, since the petitioner has made a representation, which has been duly forwarded by the concerned authority to the respondent no. 2, I direct the respondent no. 2 to consider and dispose of such representation within a period of ten weeks from date 2 upon giving a hearing to the petitioner with adequate prior notice. 5. Representation will be disposed of by passing a reasoned order which shall be communicated to the petitioner within a week thereafter. 6. I make it clear that consideration of this representation and the consequences thereof will not create any equity or right in favour of the petitioner which he did not otherwise have. The consideration will be strictly in line with his undertaking of April, 12, 2023 and the prevalent rules and regulations applicable to him. 7. With the aforestated directions, the writ petition is disposed of. 8. There will be no order as to costs. 9. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon usual undertakings. (Reetobroto Kumar Mitra, J.)
