Judge, Family Court at Chikkaballapura to Prl. Judge, Family Court at Bengaluru, to be tried along with M.C.no.3359/2024, this petition is filed. 2. Sri Ajay N., learned counsel for petitioner submitted that marriage of petitioner and respondent was solemnized on 15.08.2007 at K.R. Puram, Bengaluru. Thereafter petitioner led matrimonial life with respondent, in course of which two children were born. However, due to subsequent marital discord, petitioner had filed M.C.no.3359/2024 for dissolution of marriage before Prl. Judge, Family Court at Bengaluru. It was submitted that respondent had filed O.S.no.3/2026 for declaration before Prl. Judge, Family Court at Chikkaballapura. It was submitted that since earlier matrimonial proceedings are - 3 - HC-KAR CNR: KAHC010506542026 NC: 2026:KHC:51117 CP No. 246 of 2026 pending before Family Court at Bengaluru, proceedings before Court at Chikkaballapura, required to be transferred to Bengaluru for common trial. 3. Smt.Asha M.P., learned counsel for respondent submits that respondent had, in fact, sought to file said suit before Court at Bengaluru, but same was not permitted and respondent would have no objection for transfer. She would, however, submit that certain assertions in petition are incorrect. 4. Heard learned counsel and perused material on record. 5. This petition is for transfer of O.S.no.3/2026 presently on file of Prl. Judge, Family Court at Chikkaballapura to Prl. Judge, Family Court at Bengaluru, to be tried along with M.C.no.3359/2024, 6. In view of consensus between counsel/parties about need for trial of divorce proceedings along with suit and divorce proceedings being filed earlier to suit, petition is allowed, O.S.no.3/2026 presently on file of Prl. Judge, Family Court at - 4 - HC-KAR CNR: KAHC010506542026 NC: 2026:KHC:51117 CP No. 246 of 2026 Chikkaballapura stands withdrawn and transferred to Prl.
