4 1177..0099..22002266 Ct. No. 05 adeb WPA 22391 of 2026 Sadhan Midya Vs. The State of West Bengal & Ors. Mr. Shyamal Roy …for the petitioner Mr. Shyama Prasad Purkait Mr. Pradip Kr. Neogi Mr. Anirban Saha …for the respondent nos. 6 & 7 Mr. Saikat Roy Chowdhury Mr. Ankit Kumar Mishra …for the State 1. At the time of call accommodation is prayed for on behalf of petitioner which is refused since previously matter was taken up on 10th September, 2026 when similar prayer was made which was allowed thereby directing the matter to appear today for further consideration. 2. State respondents and respondent nos. 6 and 7 are represented by learned advocates. 3. On perusal of prayer it appears that petitioner has sought for issuance of mandamus directing the concerned police authorities to register FIR based on complaint lodged. If petitioner finds that there is inaction on the part of police authorities in transforming the complaint into an FIR in that event there is an 2 alternative remedy available to the petitioner under Section 175(3) BNSS 2023 by approaching jurisdictional Magistrate. 4. In view of availability of alternative remedy writ petition is not entertained and same stands dismissed. 5. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy. 6. Parties to act on the server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
