JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused No.3 in S.C.No.14/2023 pending before the Court of VI Addl. District and Sessions Judge, Bengaluru Rural District, Bengaluru arising out of Crime No.35/2021 registered by Jigani Police Station, Bengaluru District for the offences punishable under Sections 201, 370, 371, 376D, 302 R/w Section 34 of IPC is before this Court in this successive bail application filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. It is brought to the notice of this Court by learned HCGP that accused no.1 had approached this Court in Crl.P.No.7007/2026 seeking regular bail. He submits that accused no.1 is in custody from 23.07.2021 onwards. - 3 - HC-KAR CNR: KAHC010592832026 NC: 2026:KHC:52184 CRL.P No. 13349 of 2026 4. This Court vide order dated 06.07.2026 while dismissing the said petition as not pressed in paragraph nos.3 & 4 of the order passed in Crl.P.No.7007/2026 has observed as follows: "3. Since, the accused persons are in custody in the present case for a considerable period of time, the trial Court is directed to expedite the trial and dispose of the case on merits as expeditiously as possible, but not later than a period of 8 months from the date of receipt of certified copy of this order. 4. In the event, trial Court fails to dispose of the case as aforesaid, the petitioner is at liberty to file a fresh bail application before the trial Court on the ground of delay in trial, which shall be considered on its merits by the said Court". 5. The said observation would be applicable even to the petitioner who was arrested in the present case on 29.07.2021 and remanded to judicial custody. Under the circumstances, I am of the opinion that, this petition needs to be disposed of with liberty to the petitioner to file a fresh bail application before the Trial Court in the event trial is not - 4 - HC-KAR CNR: KAHC010592832026 NC: 2026:KHC:52184 CRL.P No. 13349 of 2026 completed and main case is not disposed of within time frame as stated as stated in Crl.P.No.7007/2026. 6.
