1. Learned advocate appearing for the petitioner submits that the petitioner is similarly if not better placed than the other accused who has been granted bail in CRM (M) 2824 of 2025.
2. Learned Public Prosecutor appearing for the State opposes the prayer for bail as the case is at an advanced stage.
3. I find that another accused, namely, Md. Babar Khan @ Babar Khan was granted bail in CRM (M) 2824 of 2025 by an order dated 9th July, 2026 because of the delay in the trial and non- compliance of the earlier order passed by the High Court at Calcutta.

4. Having considered the locus of the present petitioner and the petitioner who has been granted bail and five more witnesses are yet to be examined, I am inclined to release the petitioner on bail who is in custody for 8 years 6 months.
5. As such, the prayer for bail of the petitioner, namely, Md. Sabbir Shah @ Sabbir @ Md. Sabbir is allowed on the same terms and conditions as was imposed in the case of Md. Babar Khan @ Babar Khan in CRM (M) 2824 of 2025.
6. There were earlier directions to conclude the trial. Prosecution would ensure that at least one witness is completed in each month so that within a period of five months, rest of the witnesses are completed.
7. Accordingly, CRM (M) 2118 of 2026 is disposed of.
8. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.
9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
