JUSTICE TARA VITASTA GANJU ORAL ORDER (PER: HON'BLE MR. JUSTICE JAYANT BANERJI) This petition is filed alleging willful disobedience of the order dated 03.02.2025 passed in W.P.No.1617/2025. The operative part of the order of the writ Court reads as follows: ORDER (i) Writ petition is allowed. (ii) Tahsildar is hereby directed to mutate petitioner's name to the petition land by taking note of decree passed in O.S.No.739/2015 followed by sale deed dated 30.12.2019. (iii) This exercise shall be accomplished within a period of four weeks from the date of receipt of copy of this order. 2. The order of the writ Court was served on the Tahsildar, Anekal Taluk on 05.03.2025. In the affidavit of partial compliance dated 31.08.2026, reference is made to certain proceedings before the Special Tahsildar, Anekal and his order dated 28.08.2026. - 3 - HC-KAR CNR: KAHC010659062025 NC: 2026:KHC:51803-DB CCC No. 1312 of 2025 3. In the order dated 28.08.2026 passed by the Special Tahsildar an 'order' dated 11.09.2025 passed in W.P.No.15650/2025 is referred which directed to effect Khata based on registered Will deed executed in favour of other persons. In a matter regarding authenticity of the original grant a case is pending before the Special District Commissioner. In that case, a report is submitted. In the order by the Special Tahsildar it is stated that in respect of 4 acres of land in Survey No.68 of Bommanahalli Village, Jigani Hobli, Anekal Taluk, based on sale deed dated 30.12.2019, the khata change was ordered in the name of the petitioner subject to certain conditions. In the conditions, it is reflected that a writ appeal has been preferred against the order dated 03.02.2025. It also says that it is subject to the final order of the Special District Commissioner and if any other person establishes rights over the said land through competent civil proceedings or legal proceedings, that order would stand automatically cancelled. 4. As far as an 'order' passed in W.P.No.15650/2025 is concerned, we have perused the proceedings dated 11.09.2025 in the aforesaid W.P.No.15650/2025. Those are proceedings before the Lok Adalat. On the submission of the learned - 4 - HC-KAR CNR: KAHC010659062025 NC: 2026:KHC:51803-DB CCC No. 1312 of 2025 Additional Government Advocate made during the Lok Adalat, that the respondent authorities would consider the prayer in respect of khata transfer in terms of the judgment passed by this Court in K.V.Bhaskar Raju vs. State of Karnataka and others in W.P.No.14813/2025 dated 23.08.2025 in the matter of consideration of Will, while issuing notice to all concerned and calling for objections, learned Counsel for the petitioners therein submitted in that petition that the petitioners will be satisfied if such action is taken and the matter stood disposed of accordingly. 5. It is pertinent to mention here that there were only two petitioners in W.P.No.15650/2025 namely, Theerthesha and Vijayakumar. The respondents were all State respondents. The complainant was not a party. Therefore, reference made to the aforesaid proceeding in the Lok Adalat in the conditions imposed in the order of the Special Tahsildar, does not reflect the sterling conduct of the accused- Special Tahsildhar. 6. However, in the compliance affidavit filed today, paragraph Nos.7, 8 and 9 state as follows:- “7. Accordingly, Mutation Register No. T7/2026- 2027 was effected on 19.09.2026. Pursuant thereto, the name of the complainant, Sri H.C. - 5 - HC-KAR CNR: KAHC010659062025 NC: 2026:KHC:51803-DB CCC No. 1312 of 2025 Krishnachari, S/o Chikkadoddachari, has been entered in the Record of Rights, Tenancy and Crops in respect of the petition land measuring 4 acres. 8. The updated RTC of Sy.No.68 of Bommanahalli Village, valid from 19.09.2026, reflects the complainant's name and the extent of 4 acres, and also records Mutation Register No. T7/2026-2027 dated 19.09.2026 in Column No.10. A true copy of the updated RTC is produced herewith and marked as Annexure-R3. 9. I respectfully submit that the entry in the remarks column of the RTC refers to the pending proceedings in RRT(A)CR/154/2010-11 and W.A.No.2019/2026. Those proceedings are disclosed with utmost candour. Their pendency has not been treated as an impediment to implementation, and the complainant's name has in fact been entered in the revenue records in compliance with the order dated 03.02.2025.” 7. We find that now the accused have gained wisdom and submitted a better affidavit. The contempt petition is therefore consigned.
