This petition is filed to quash proceeding in C.C. No.329/2026 registered by Malavalli Rural Police Station, pending before JMFC, Malavalli for the offences punishable under Sections 115(2) and 85 of Bharatiya Nyaya Sanhita,
2023.

Learned counsel for the petitioner would submit that respondent No.2-complainant had obtained a decree for dissolution of marriage against her first husband by accepting alimony of Rs.3,50,000/-. After marrying the petitioner by suppressing the earlier marriage, complainant is demanding alimony and to achieve her object alimony, has filed a false complaint. 3. It is the contention that she has levelled allegations against several family members and the Police officer. The Investigation Officer has filed the charge sheet only against the husband and the false allegations made against the remaining family members is very much established. Thus, the learned counsel would urge that the petition has to be allowed.
4. Learned High Court Government Pleader would submit that there are materials in the charge sheet which require trial and the contentions in the petition has to be tested in a trial.
5. The Court has considered the contentions raised at the Bar and perused the records.

Merely because the complainant-respondent No.2 had filed a petition seeking dissolution of marriage against her first husband and secured alimony of Rs.3,50,000/- the Court cannot jump to the conclusion that this complaint is filed with an intention to secure alimony. Merely because the charge sheet is not filed against the remaining persons named in the complaint, one cannot jump to the conclusion that the Digitally Signed by ANANT RAMNATH HEGDE

complaint against the petitioner is also false. These contentions which are raised by the petitioner have to be taken into
consideration at the time of trial.
7. Under these circumstances, the Criminal Petition is dismissed.
8. This dismissal order should not be construed as the reflection on the merits of the contentions of either of the parties.
9. All contentions are kept open to be tried at the time of trial.
10. The contentions raised by the petitioners are based on disputed questions of facts.
