25/02/2026 D/L – 8 Court No.28 S. Kundu Rejected C.R.M.(A) 4877 of 2023
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Gaighata P.S case no. 497/19 dated 11/7/2019 under Sections 188/379/411/353/333/307/427/120B of the IPC and 9(b) of the I.E Act. In the matter of: Suman Ghosh ...Petitioner. Mr. Gourab Kr. Nath Mr. Tamal Singha Roy Mr. Biplab Pal …for the petitioner. Mr. Rudradipta Nandy Mr. Iqbal Kabir …for the State.
1. Report filed on behalf of the State is taken on record.
2. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case. Apart from the statement of a co-accused, there is no other material available against the petitioner.
3. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. He submits that the petitioner and others accused were smuggling cattle through the Bangladesh Border. When they were challenged by the BSF personnel, they hurled bombs, causing grievous injuries to the BSF personnel. Some were intercepted, but the others fled away. The petitioner is one of them who fled away. The petitioner was named
2
in the FIR that was lodged in the year 2019. The petitioner has remained absconding since then.
4. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
5. Accordingly, the application for anticipatory bail is rejected.
