17th September, 2026 (D/L No.25) Ct. No.4 (SKB) W.P.S.T. 129 of 2026 Dr. Arnab Dutta Versus The State of West Bengal and others Mr. S. Ghosh, Mr. M. N. Roy, Mr. G. Halder, Mr. B. Nandy … for the petitioner. Mrs. Chandreyi Alam, ld. AGP, Ms. Runu Mukherjee … for the State. 1. The matter relates to the request for resignation from service of the writ petitioner. 2. The learned AGP hands over written instruction dated 9th September, 2026 issued by the Director of Medical Education, West Bengal. It is apparent from the instruction that the competent authority decided to accept the writ petitioner’s resignation w.e.f. 12.08.2012. Acceptance is subject to obtaining his Integrity Clearance by the State Vigilance Commission, West Bengal and by the Vigilance Branch of H&FW Department, Government of West Bengal. The instruction further states that necessary action for obtaining such clearance is being taken by the authorities, which is likely to take 3 to 4 months. The instruction, therefore, does not require any further directions to be issued in 2 so far as the substantial relief of resignation is concerned. The copy of the instruction dated 09.9.2026 is taken on record. 3. However, we are of the view that the authorities should complete the entire exercise within a reasonable time, rather than expressing that it is likely to be concluded within 3 to 4 months. 4. Let the entire exercise, in terms of the communication dated 09.9.2026, be completed within 8 weeks from the date of production of a copy of this order. 5. The writ petition is, accordingly, disposed of. 6. The parties are in agreement that in view of disposal of the writ petition, pendency of the contempt application before the Tribunal bearing CCP No.1 of 2026 (O.A. 240 of 2025) would serve no useful purpose as the same has become infructuous. 7. The contempt application, thus, also stands disposed of. 8. Copy of this order be communicated to the Registry of the West Bengal Administrative Tribunal for information. (Madhuresh Prasad, J.)
