1. The affidavit-of-service filed by the petitioner be kept with the record.

The petitioner has filed the present writ application on the ground that the name of the petitioner has been deleted from the voter list and accordingly, the petitioner has preferred an appeal before the appellate Tribunal but the same has not been considered till date and prays for expeditious disposal of the appeal.

In the meantime, the petitioner has been selected for the post of Post-Graduate Teacher (Biology) in the Kendriya Vidyalaya Sangathan/Navodaya Vidyalaya Samiti but due to the deletion of the name of the petitioner, the authorities are not providing OBC (NCL) certificate to the petitioner due to which the petitioner is not in a position to submit the said document before the authority.

Learned counsel for the petitioner submits that the interview of the petitioner is on October 1, 2026 and if the petitioner is not provided with OBC (NCL) certificate,
2 the petitioner will not be in a position to attend the interview and will not get an order of appointment for the post of Post-Graduate Teacher (Biology). He prayed for a direction upon the SDO, Berhampore Sadar, Murshidabad to provide the OBC (NCL) certificate to the petitioner pending disposal of the appeal before the appellate Tribunal.
5. Considering the submission made by the learned counsel for the petitioner, this Court finds that the petitioner has already preferred an appeal against the deletion of the name of the petitioner from the voter list and the same is pending before the appellate Tribunal.
6. Accordingly, the appellate Tribunal is requested to dispose of the appeal of the petitioner as early as possible preferably within a period of two weeks from the date of receipt of this order.

The petitioner is selected for the post of Post-Graduate Teacher (Biology) in the Kendriya Vidyalaya and an interview is fixed on October 1, 2026 but the authorities are not provided the OBC (NCL) certificate to the petitioner which is required to be produced at the time of interview for getting the appointment order. The respondent no. 8, the SDO, Berhampore Sadar, Murshidabad is directed to immediately issue OBC (NCL) certificate to the petitioner if the petitioner is otherwise eligible for getting the said certificate without taking into
consideration that his name has been deleted from the voter list. The petitioner shall submit an undertaking before the SDO that in case the petitioner failed to succeed in the appeal preferred by the petitioner before
3 the appellate Tribunal, the petitioner will surrender the said certificate before the authority within a period of one week from the dismissal of the appeal.
8. WPA 26175 of 2026 is disposed of.
9. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
