Accused No.1 in Crime No.39/2026 registered by Viswanathapura Police Station, Bengaluru Rural District, for the offences punishable under Sections 103(1), 115(2), 118(1), 74, 352, 351(3) and 3(5) of BNS, 2023, is before this Court, in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.39/2026 was registered by Viswanathapura Police Station, Bengaluru, for the aforesaid offences against petitioner and others, based on the first information dated 20.02.2026 received from Prajwal, who is one of the injured victim in the present case. During the course of investigation, petitioner was arrested on 21.02.2026 and remanded to judicial custody. After completing investigation, charge sheet is filed against three persons and petitioner is arrayed as accused No.1 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.15168/2026 was rejected on 14.08.2026. Learned counsel for the petitioner submits that accused Nos.2, 3 and 4 have already been enlarged on bail. The alleged eye witnesses are planted and petitioner is falsely implicated in the present case, after he was earlier acquitted in the POSCO case registered against him. Investigation of the case is already completed. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, has opposed the petition. He submits that CW1 and CW2 are injured eye witnesses in the present case. Petitioner had motive to commit the crime. He is a person with criminal antecedents. Accordingly, he prays to dismiss the petition. 6. The material on record would go to show that as against petitioner herein, a case was earlier registered in Crime No.101/2024 for the offences punishable under Sections 4(2), 5(L) and 6 of the POCSO Act, 2012 and Sections 366A, 344 and 376(3) of IPC on the allegation that he had kidnapped CW24, who is the sister of CW1 and daughter of deceased - Renuka, and had sexual intercourse with her. As a result, CW24 had become pregnant. In the said case, petitioner, who was tried - 4 - HC-KAR CNR: KAHC010605762026 NC: 2026:KHC:51502 CRL.P No. 13560 of 2026 for the charge sheeted offences was acquitted by a detailed order dated 14.01.2026. 7. The allegation in the present case is that on 20.02.2026, when deceased Renuka, was sweeping the front yard of her house, petitioner, who came there in a motorbike bearing registration No.KA-50-W-8836 started abusing Renuka using filthy language. Thereafter, he also stated that he would be marrying her daughter CW24 and threatened her of dire consequences in the event, they performed the marriage of CW24 with some other boy. When Renuka questioned the petitioner, he allegedly pushed her and assaulted her with his hands on her chest and other parts of the body. When CW1 and CW2 tried to intervene, petitioner allegedly assaulted even them. As a result of the assault made by the petitioner, Renuka, who had suffered grievous injuries was admitted to Hospital at Devanahalli, but she died in the Hospital while undergoing treatment on 20.02.2026. 8. As against accused Nos.2 and 3, who have been granted regular bail by this Court in Crl.P.No.5845/2026 C/w - 5 - HC-KAR CNR: KAHC010605762026 NC: 2026:KHC:51502 CRL.P No. 13560 of 2026 Crl.P.No.5837/2026, the allegation is that they had come to the spot subsequently and had assaulted Renuka with their hands and legs. Insofar as petitioner is concerned, he allegedly had quarreled with her and assaulted her on her chest with his hands and as a result, she had fallen down. CW1 and CW2, who are the injured eye witnesses in the present case were also assaulted by the petitioner when they tried to intervene. Under the circumstances, I am of the opinion that at this stage, prayer made by the petitioner for grant of regular bail cannot be entertained, considering the nature of allegations found against him and also his past antecedents. Accordingly, the following order:- 9. The criminal petition is dismissed with liberty to the petitioner to renew his bail application before the jurisdictional Sessions Court after CW1 and CW2 are examined before the Trial Court.
