1. Complaining violation of the order of status quo dated 13th September, 2024 passed by the Court of learned Civil Judge (Senior Division), Diamond Harbour in T.S. No. 319 of 2024, the present writ petition has been filed.
2. The learned advocate for the petitioners would submit that in derogation of the order of injunction construction is being carried out.
3. Ms. Chakraborty, learned advocate appears for the respondent No. 23. She would submit that the construction has been carried out in accordance with sanctioned building plan.
4. Having heard the learned advocates for the respective parties and upon going through the materials on record, I find that the petitioners are trying to implement an order of status quo and/or complain violation of the said order passed by the learned trial

Court. Ordinarily, when a specific remedy has been provided for under the Code of Civil Procedure, 1908 to seek enforcement of an order of status quo, a writ petition in my view would not be maintainable.
5. The writ petition is accordingly dismissed without any order as to costs.
6. It is made clear that since the writ petition has been dismissed at the threshold, this Court has not decided on any of the issues raised in the present petition.
