Accused in S.C.No.347/2026 pending before the Court pending before the Court of XIII Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.725 of 2025 registered by K.R. Puram Police Station, Bengaluru City for offences punishable under Sections 109, 118(2), & 352 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.725 of 2025 was registered by K.R. Puram Police Station, Bengaluru City for offence punishable under Section 109 of BNS, 2023 against petitioner herein, based on first information dated 21.09.2025 received from the Sri Mukundan, who is the injured victim in the present case. During the course of investigation of the present case, petitioner was arrested on 22.09.2025 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.25373/2026 was rejected on 06.05.2026. A reading of the first information as well as the charge sheet filed in the present case would reveal that the petitioner and the injured victim were acquainted with each other and they both were addicted to alcohol. On 21.09.2025, injured victim (CW1), had gone to Brindavan bar & restaurant for consuming alcohol and at about 4.00 p.m., while he was returning home after consuming alcohol, petitioner allegedly confronted him and abused him. When CW1 enquired as to why petitioner was abusing him, the petitioner allegedly took out the machete and assaulted CW1 with the same and as a result, CW1 had suffered injuries on his left and right hand. CW1 who was admitted in the hospital has been discharged from hospital and his condition is said to be stable. The petitioner has not assaulted CW1 on any vital part of his body. The petitioner is in custody in the present case for the last one year and trial in the case is yet to commence. 5. Considering the aforesaid aspects of the matter, the following:- ORDER (i) Criminal petition is allowed. - 4 - HC-KAR CNR: KAHC010558222026 NC: 2026:KHC:51755 CRL.P No. 12378 of 2026 (ii) The petitioner is directed to be enlarged on bail in S.C.No.347/2026 pending before the Court pending before the Court of XIII Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.725 of 2025 registered by K.R. Puram Police Station, Bengaluru City for offences punishable under Sections 109, 118(2), & 352 of BNS, 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of - 5 - HC-KAR CNR: KAHC010558222026 NC: 2026:KHC:51755 CRL.P No. 12378 of 2026 the said Court until the case registered against him is disposed off.
