During the course of submissions, both the parties submit that the present petition may be disposed of with a direction to the learned trial court to dispose of Misc. Case 26 of 2021 expeditiously preferably within eight weeks in accordance with law after giving the parties an opportunity of being heard. 2. The Court has considered the submissions. Admittedly, the application under Section 24 of the Hindu Marriage Act is still pending. The effect of pendency, Section 24 HMA application is that the main suit i.e., Matrimonial Suit No. 831 of 2020 might have not proceeded further. 3. Thus, taking into account the entire facts and circumstances, let the written statement filed by the opposite party/wife be taken on record. 4. The learned trial court shall decide under Section 24 HMA application expeditiously preferably within eight weeks after giving the parties an 2 opportunity of being heard in accordance with law. Consequently upon disposal of Section 24 HMA application, learned trial court shall make endeavour to dispose of the main Matrimonial Suit No. 831 of 2020 expeditiously without granting any unnecessary adjournment in accordance with law. 5. Accordingly, the present petition stands disposed of. 6. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Dinesh Kumar Sharma, J.)
